Sixteen States Sue Trump Administration Over National Emergency Declaration

Sixteen states led by California sued the Trump administration on Monday over his decision to declare a national emergency to secure funding for the border wall.

The lawsuit filed in U.S. District Court for the Northern District of California came just days after Trump invoked emergency powers on Friday after Congress declined to fulfill his request for $5.7 billion to help build the wall that was his signature 2016 campaign promise. His move aims to let him spend money appropriated by Congress for other purposes..

“Today, on Presidents Day, we take President Trump to court to block his misuse of presidential power,” California Attorney General Xavier Becerra said in a statement. “We’re suing President Trump to stop him from unilaterally robbing taxpayer funds lawfully set aside by Congress for the people of our states. For most of us, the Office of the Presidency is not a place for theater,” added Becerra, a Democrat.

New Mexico, Oregon, Minnesota, New Jersey, Hawaii and Connecticut are among several states that are joining the lawsuit, CBS reported.

California Attorney General Xavier Becerra said on Sunday, “We’re going to try to halt the President from violating the Constitution.”

House Democrats are also going after President Trump for declaring a national emergency.

The Democrat-led House Judiciary Committee announced Friday it launched an investigation into President Trump’s declaration of a national emergency at the southern border.

President Trump’s declaration of a national emergency is completely lawful. If Congress has a problem with the President declaring national emergencies, they should change the existing laws.

Existing laws allow the president of the United States to reprogram existing appropriations for certain purposes.

President Trump declared a national emergency Friday citing cartel violence, human trafficking and drug trafficking to access funds to build the border wall.

Where was the outrage after Obama Declared National Emergencies 13 Times Including Swine Flu, Iran and Flint Water Crisis?

US Presidents declaring national emergencies is nothing new, only the outrage is.
