Craig Nathaniel already did his time for walloping a Bronx street thief with an aluminum bat — but it may not be enough.

Nathaniel could face upgraded charges and possible jail time in the Dec. 23, 2017, death of Carmelo De La Cruz-Ortega, who lingered for exactly five years after he was cracked in the head while boosting rear-view mirrors off parked cars.

“It was so long ago and I was a kid,” Nathaniel said Thursday about his fatal encounter with the street thief. “I wasn’t in the wrong but it was a real sad thing.”

Ortega’s death was only ruled a homicide last week, raising the possibility of a new prosecution under New York State’s “delayed death” exception to double jeopardy laws.

“I didn’t kill nobody,” Nathaniel, now 33, insisted to the Daily News. “I’m a good guy and it was an accident.”
