The wealthy Mexican tycoon who was arrested after his 11-year-old son died in a California boating accident likely won’t face charges, according to a report.

Javier Burillo, 57, was released Monday from Marion County Jail on $1 million bail, though no charges have been filed in the fatal boat trip, news station KPIX reported.

Due to an agreement with prosecutors, his lawyer, Douglas Horgrad, said that charges are not expected in the case.

“Given the facts as I know them, I expect no charges will be filed in this tragic horrible accident,” Horngrad told the station.

The Belvedere father was piloting the boat over the weekend in the San Francisco Bay when his two sons were ejected by a wave near Angel Island, according to the Tiburon Police Department.
