The jury in the trial of the three men who killed Ahmaud Arbery began deliberating on Tuesday, in a case that has become part of the ongoing national reckoning about race and justice.

The disproportionately white, 12-person panel is deciding the fate of Travis McMichael, 35, who pulled the trigger; his father, 65-year-old Greg McMichael, who drove their pickup truck, and William “Roddie” Bryan, who drove his own truck and joined the chase, then filmed the fatal encounter on his cell phone.

All three are charged in a nine-count indictment with one count each of malice murder, four counts of felony murder, two counts of aggravated assault, one count of false imprisonment and one count of criminal attempt to commit false imprisonment. Neither malice murder nor felony murder require prosecutors to prove they intended to kill.

Federal authorities have charged all three men with hate crimes, alleging that they chased and killed Arbery because he was Black. Their trial for that is set to begin in February.

Defense attorneys have worked to prove that the McMichaels and Bryan were trying to conduct a lawful citizen’s arrest when they cornered Arbery, and that it went horribly wrong but was not targeted.
