DOVER, Del. (AP) - A Delaware judge has rejected a defendant’s argument that he should be found guilty but mentally ill in a Wilmington store clerk’s murder.

Twenty-five-year-old Devonte Dorsett pleaded guilty last year to second-degree murder, robbery and gun charges in the 2017 killing of 64-year-old Santanu Muhuri.

Investigators say Dorsett pointed a gun at Muhuri, then shot him in the head as the two struggled. Dorsett and a juvenile accomplice fled with $20.

The judge disagreed Monday, saying the record didn’t demonstrate that attention deficit hyperactivity disorder, post-traumatic stress disorder and borderline intellectual function were mental illnesses that substantially disturbed Dorsett’s thoughts or actions in robbing and killing Muhuri.
