“State law provides several emergency powers to local governments to control movement within their region during a disaster, which serves our communities well during public health events like the one we’re fighting now,” Texas Attorney General Ken Paxton wrote in a non-binding legal opinion on Friday.

“However, local regulation of the sale, possession, and ownership of firearms is specifically prohibited under Texas law. Under our laws, every Texan retains their right to purchase and possess firearms.”

Paxton’s ruling came as Texas residents completed their first week in lock down aimed at curtailing the spread of the coronavirus.

Gov. Greg Abbott on March 19 issued an executive order limiting public gatherings to 10 people, closing schools, banning visitors to nursing homes and retirement communities and limiting bars and restaurants to take-out through April 3.

State Rep. Dustin Burrows requested an opinion from Paxton on Tuesday, noting that many Texas cities did not provide a caveat for gun stores, which are typically labeled as non-essential, according to the Houston Chronicle.
