Environmental groups opposing the site of an oil refinery being developed near Theodore Roosevelt National Park in North Dakota want a judge to reconsider his recent recommendation that state regulators dismiss the groups' challenge.

The Environmental Law and Policy Center and Dakota Resource Council say Davis Refinery developer Meridian Energy didn't update the state Health Department about its decision to lower the refinery's capacity. They say that might indicate the project might end up being larger than the company says.

Company CEO William Prentice has signed an affidavit saying it won't be. And Meridian maintains it had no reason or requirement to update the Health Department because the revision won't result in higher emissions.

The environmental groups question that. They say a decrease in capacity could result in less efficiency.
