The Dallas ex-cop was convicted in October 2019 of murdering Botham Jean, a 26-year-old Black man, in his apartment a year earlier. Guyger, who testified that she thought it was her apartment and that Jean was an intruder, was sentenced to 10 years in prison.

Guyger’s lawyers argued in their appeal filing that Guyger’s apartment confusion meant she feared for her life and was therefore justified in gunning down Jean, local ABC affiliate WFAA reported. The attorneys argued that if anything, Guyger should have been convicted of negligent homicide.

A negligent homicide conviction carries only a maximum two-year sentence in Texas, according to local Fox affiliate KDFW.

“I feel furious about it,” Jean’s mother, Allison, told local NBC affiliate KXAS. “It really made me question the nerve of Amber Guyger and her attorneys to even think of wanting to file an appeal.”

Guyger, who had just finished her shift and was still wearing her police uniform, entered Jean’s apartment on Sept. 6, 2018 and fatally shot him while Jean was sitting on his couch. She has said repeatedly that she thought she had entered her own apartment, which was one floor directly below.
